SLIPS AND TRIPS

The term “premises liability” refers to a set of rules that require property owners in Texas to take certain measures that ensure their property is safe for visitors. This includes commercial and residential properties.  If an individual is injured on another person’s property due to unsafe conditions or negligence, the property owner can be held liable for damages under premises liability law. 


Whether an injured individual may be entitled to compensation begins with a determination of their purpose for being on the premises.  Visitors are classified as:  licensees, invitees, or trespassers, with each classification impacting the level of duty owed by the premises owner. Once the classification and duty owed is established, in order to establish liability, the injured party must show that:


  • A dangerous condition was present on the property
  • The condition caused an injury
  • The operator of the premises created, knew, or should have known about the condition
  • The operator of the premises failed to correct the condition before the injury occurred

Statute of Limitations
