Car Accidents

Texas has more miles of road than any other state, a fact that is reflected in the rates of auto accidents. If you were seriously injured by the negligence of another driver, you deserve full and fair compensation. But you cannot count on insurance companies to do the right thing. The wise move is to consult an experienced and aggressive personal injury attorney.

In Mansfield and surrounding areas, you can find the help you’re looking for at Bradlyn J. Cole & Associates, PLLC. With more than a decade of legal experience, attorney Cole has proven to be an effective legal advocate both in and out of the courtroom. He has recovered tens of millions of dollars on behalf of thousands of injured Texans. Chances are good that he can help you, too.

Truck & 18 Wheeler Accidents

18-wheelers are a common site on Texas roads. The state’s vast network of highways is a critical delivery route for goods destined for delivery locally and throughout the United States. Unfortunately, all of this truck traffic comes at a high cost to other drivers, as semi-truck accidents are frequent and often devastating.

Each case is unique, but many trucking accidents share common causes and contributing factors. Your accident may have involved one or more of the following:

  • Truck driver fatigue/drowsy driving
  • Distracted, drunk or drugged driving
  • Speeding and aggressive driving (to compensate for unreasonable delivery deadlines)
  • Equipment problems, especially worn-out brakes and bald tires
  • Truck drivers who are inexperienced, poorly trained and improperly monitored

If the truck driver was at fault for causing the crash, the driver and their employer can typically be held liable. Depending on the details of the crash and the factors leading to it, other potential defendants may include the company responsible for loading the truck at the warehouse, the truck manufacturer or parts manufacturer, mechanics conducting service and maintenance and more.

It is common for personal injury attorneys to “cast a wide net” early on in legal proceedings to identify as many potentially liable parties as possible.

Motorcycle Accidents

Everyone legally driving a motor vehicle has an equal right to use Texas roads and highways. That’s how things work in theory, but not always in practice. Motorcyclists are too often treated as unwelcome intruders and are not afforded the same respect and consideration as drivers of four-wheeled vehicles. Motorcycle accidents are common, and many are catastrophic.

Motorcycles are smaller and lighter than other vehicles and offer no protection in a collision. Bikers typically know that their lives are on the line, which is why most riders are cautious and attentive. When an accident occurs between a motorcyclist and the driver of a car or truck, it is often due to the other driver’s negligence. Common causes and scenarios include:

  • Left-turn accidents in which inattentive drivers make a left turn across the path of an oncoming biker
  • Rear-end crashes that occur because drivers cut off motorcyclists or stop suddenly when a biker is behind their vehicle
  • Crashes caused by drunk and drugged drivers
  • Failure to yield the right of way

Sadly, many motorcycle accidents occur simply because drivers fail to keep a lookout for anything smaller than another car. Motorcyclists often go unnoticed until it’s too late and a crash is imminent.

If you or a loved one was seriously injured in a motorcycle crash in Mansfield or surrounding areas, contact Bradlyn J. Cole & Associates, PLLC, for the skillful and aggressive legal representation you deserve.

WhAT Damages Can You Claim After A MOTOR VEHICLE Accident?

In legal speak, “damages” refers to monetary compensation owed for harms and losses suffered. Each accident is unique, so the type and amount of damages will vary. That being said, victims can often seek damages for things like:

  • Medical bills (current and future)
  • Lost wages from time spent unable to work
  • Reduction in or loss of earning capacity for those who suffer permanent disability or are unable to return to the work they used to perform
  • Property damage
  • Costs of services and adaptations needed to compensate for a disability
  • Pain and suffering
  • Scarring and disfigurement
  • Reduced quality of life

Defendants commonly try to argue that a car accident victim already had an existing injury and that the defendant is therefore not liable for harm to that body part. Thankfully, Texas law recognizes that preexisting conditions or injuries are compensable if they were made worse by the accident. This is known as the “eggshell plaintiff” rule.

Statute of Limitations

In the State of Texas, the statute of limitations on most personal injury claims is two years from the date that the cause of action accrues unless an exception is met, such as the claimant is a minor or the claim is not discoverable until later.  A cause of action typically “accrues” at the time in which an injury caused by another should be realized.  Once the statute of limitations has expired, you likely will be unable to successfully pursue a lawsuit regardless of the merits of your claim. If you have been injured and believe it is due to the negligence or intentional acts of another person or entity, seek medical care then contact Our Firm to evaluate your claim and ensure your right to a recovery is preserved.
